1. Acceptance
These Terms of Service (“Terms”) govern the domusgtcorp.com website and the Proa service (the “Service”), operated by DOMUS GT CORP (“we”, “us”, “our”), located at 301 S Tubb St Unit G1, Oakland, FL 34760, United States. By accessing the website or using the Service, you agree to these Terms. If you act on behalf of a company, you represent that you have authority to bind it, and “you” refers to that company.
2. The Service and its current status
Proa is a CRM platform for consultative sales over WhatsApp and Instagram, using Meta’s official APIs, with campaign/broadcast features and AI agents. The Service is under active development and is currently offered as early access with assisted pilots. Features may change, be interrupted or be discontinued, and no service levels apply unless agreed in writing.
3. Eligibility and business use
The Service is intended exclusively for business use. You must be at least 18 years old and use the Service in the course of a business activity.
4. Early-access program
Admission to the early-access program is at our discretion and may be subject to additional written pilot terms agreed with each customer. Either party may end a pilot at any time upon written notice.
5. Accounts and access
You agree to provide accurate information, keep credentials confidential, and remain responsible for the activity of your team members under your account.
6. Customer data
You retain all rights to the data you and your clients submit through the Service (“Customer Data”). You grant us a limited license to process Customer Data solely to provide, secure and improve the Service, as described in our Privacy Policy. You are responsible for having a lawful basis — including any required consents and opt-ins — to communicate with your clients through the Service.
7. Acceptable use
You agree to comply with applicable laws (including, where applicable, the Brazilian LGPD) and with the terms and messaging policies of Meta, WhatsApp and Instagram. You must not use the Service to send unsolicited messages (spam), harass, defraud, distribute unlawful content or malware, attempt to breach security, reverse engineer the Service, or resell it without our written consent. We may suspend or terminate access in case of violation.
8. Third-party platforms
The Service depends on third-party platforms and APIs, notably Meta’s WhatsApp Business Platform and Instagram Messaging. Their availability, pricing and policies are controlled by Meta, not by us, and your use of those platforms is subject to Meta’s own terms. We are not responsible for changes, limitations or outages in third-party platforms.
9. Fees
Any fees for the Service or for pilots will be agreed in writing before they apply. We will not charge you without a prior written agreement.
10. Intellectual property
The Service, including its software, design and brand, is owned by DOMUS GT CORP. We grant you a limited, non-exclusive, non-transferable license to use the Service during your access period. If you send us feedback, we may use it freely to improve the Service, without obligation.
11. Disclaimers
The Service is provided “as is” and “as available”, especially during early access. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
12. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue or data. Our aggregate liability under these Terms is limited to the amounts you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim or, if you have paid nothing, one hundred U.S. dollars (US$ 100). Nothing in these Terms excludes liability that cannot be excluded under applicable law.
13. Termination
Either party may terminate access to the Service upon written notice, without prejudice to accrued obligations. Upon termination, Customer Data will be handled as described in the Privacy Policy and in any applicable pilot terms.
14. Governing law and venue
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware will have exclusive jurisdiction over disputes arising from these Terms. Mandatory rights granted by the law of your place of residence — including, where applicable, Brazilian consumer and data-protection law — remain unaffected to the extent they cannot be waived.
15. Changes to these Terms
We may update these Terms from time to time. The current version, with its date, will always be available on this page. Continued use of the Service after changes take effect constitutes acceptance.

Estes Termos de Serviço (“Termos”) regem o site domusgtcorp.com e o serviço Proa (o “Serviço”), operados pela DOMUS GT CORP (“nós”), localizada em 301 S Tubb St Unit G1, Oakland, FL 34760, Estados Unidos. Ao acessar o site ou usar o Serviço, você concorda com estes Termos. Se você atua em nome de uma empresa, declara ter poderes para vinculá-la, e “você” passa a designar essa empresa.
2. O Serviço e seu estágio atual
O Proa é uma plataforma de CRM para venda consultiva pelo WhatsApp e pelo Instagram, usando as APIs oficiais da Meta, com recursos de campanhas/broadcast e agentes de IA. O Serviço está em desenvolvimento ativo e é oferecido hoje como acesso antecipado com pilotos assistidos. Funcionalidades podem mudar, ser interrompidas ou descontinuadas, e não há níveis de serviço garantidos, salvo acordo por escrito.
3. Elegibilidade e uso empresarial
O Serviço destina-se exclusivamente a uso empresarial. Você deve ter pelo menos 18 anos e usar o Serviço no exercício de atividade empresarial.
4. Programa de acesso antecipado
A admissão ao programa de acesso antecipado fica a nosso critério e pode estar sujeita a termos de piloto adicionais, acordados por escrito com cada cliente. Qualquer das partes pode encerrar um piloto a qualquer momento, mediante aviso por escrito.
5. Contas e acesso
Você concorda em fornecer informações corretas, manter credenciais em sigilo e responder pela atividade dos membros da sua equipe na sua conta.
6. Dados do cliente
Você mantém todos os direitos sobre os dados que você e seus clientes enviam pelo Serviço (“Dados do Cliente”). Você nos concede uma licença limitada para tratar os Dados do Cliente exclusivamente para fornecer, proteger e melhorar o Serviço, conforme a nossa Política de Privacidade. É sua a responsabilidade de ter base legal — incluindo consentimentos e opt-ins exigidos — para se comunicar com seus clientes pelo Serviço.
7. Uso aceitável
Você concorda em cumprir a legislação aplicável (incluindo, quando cabível, a LGPD) e os termos e políticas de mensagens da Meta, do WhatsApp e do Instagram. É vedado usar o Serviço para enviar mensagens não solicitadas (spam), assediar, fraudar, distribuir conteúdo ilícito ou malware, tentar violar a segurança, fazer engenharia reversa do Serviço ou revendê-lo sem nossa autorização por escrito. Podemos suspender ou encerrar o acesso em caso de violação.
8. Plataformas de terceiros
O Serviço depende de plataformas e APIs de terceiros, em especial a WhatsApp Business Platform e o Instagram Messaging, da Meta. Disponibilidade, preços e políticas dessas plataformas são controlados pela Meta, não por nós, e o seu uso delas está sujeito aos termos da própria Meta. Não respondemos por mudanças, limitações ou indisponibilidades em plataformas de terceiros.
9. Preços
Quaisquer valores pelo Serviço ou por pilotos serão acordados por escrito antes de serem aplicados. Não haverá cobrança sem acordo prévio por escrito.
10. Propriedade intelectual
O Serviço, incluindo software, design e marca, pertence à DOMUS GT CORP. Concedemos a você uma licença limitada, não exclusiva e intransferível para usar o Serviço durante o período de acesso. Se você nos enviar sugestões, poderemos usá-las livremente para melhorar o Serviço, sem obrigação.
11. Isenções de garantia
O Serviço é fornecido “no estado em que se encontra” e “conforme disponível”, especialmente durante o acesso antecipado. Na máxima extensão permitida em lei, afastamos garantias expressas ou implícitas, incluindo comerciabilidade, adequação a uma finalidade específica e não violação.
12. Limitação de responsabilidade
Na máxima extensão permitida em lei, não responderemos por danos indiretos, incidentais, especiais, consequenciais ou punitivos, nem por lucros cessantes, perda de receita ou de dados. Nossa responsabilidade total sob estes Termos limita-se aos valores pagos por você pelo Serviço nos doze (12) meses anteriores ao evento que originou a reclamação ou, se nada tiver sido pago, a cem dólares americanos (US$ 100). Nada nestes Termos exclui responsabilidade que não possa ser excluída pela legislação aplicável.
13. Rescisão
Qualquer das partes pode encerrar o acesso ao Serviço mediante aviso por escrito, sem prejuízo das obrigações já constituídas. Encerrado o acesso, os Dados do Cliente serão tratados conforme a Política de Privacidade e os termos de piloto aplicáveis.
14. Lei aplicável e foro
Estes Termos são regidos pelas leis do Estado de Delaware, EUA, sem aplicação de suas regras de conflito de leis. Os tribunais estaduais e federais localizados em Delaware terão jurisdição exclusiva sobre disputas decorrentes destes Termos. Direitos irrenunciáveis garantidos pela lei do seu local de residência — incluindo, quando aplicável, a legislação brasileira de consumo e de proteção de dados — permanecem preservados.
15. Alterações destes Termos
Podemos atualizar estes Termos periodicamente. A versão vigente, com a respectiva data, estará sempre disponível nesta página. O uso continuado do Serviço após a entrada em vigor das mudanças significa aceitação.
